Partecipant Declaration

Having read the programme and the general rules I agree to them. I know that participating and running in a Marathon (or other running event) is a potentially hazardous activity. I agree not to enter and participate unless I am medically able and properly trained. I agree to abide by any decision of a race official relative to my ability to safety complete the Events. I am voluntarily entering and assuming all risks associated with participating in the Events including, but not limited to, falls, contact with vehicles, other participants, spectators or others, the effect of weather, including high heat, extreme cold, and/or humidity, traffic and the conditions of the road, all such risks being known and appreciated by me.
I grant my permission to BORN2RUN by Melville Travel & Leisure Srl to use photographs, motion pictures, recordings, or any other  record of my participation in the Events for any legitimate purpose without remuneration.

Privacy Rulement

The Participant authorizes BORN2RUN by Melville Travel & Leisure Srl to use his personal information only for the execution of this contract, including the introduction and the publication of such information on the race results. The Participant also agrees that BORN2RUN by Melville Travel & Leisure Srl can use his personal information to be sent for advertisement and general information and can also use his image on paper or other media.

Contract

1. CONTRACT AND LIABILITY.
The undersigned enters into this contract with the organizing company BORN2RUN by Melville Travel & Leisure Srl in his own name and on behalf of those people he acts for. From this moment on, he will be referred to as "Participant". The contract is subject to the laws in force and to international conventions. 
In no event BORN2RUN by Melville Travel & Leisure Srl 's liability will exceed the amount defined by the Bruxelles Convention of 1970, ratified with the Italian law 27/12/1977 n. 1084. 

2. SPORT COMPETITIONS. 
If the Participant takes part in a sport competition, even if it is explicitly included in the programme, he does so at his own risk and BORN2RUN by Melville Travel & Leisure Srl is exempted from any liability. By signing this contract, the Participant accepts the regulations established by the organizing body of the competition itself, and he acknowledges that he has read, understood and agreed to such regulations. 

3. BOOKING. 
Booking applications must be submitted by completing and signing the Booking Form, and they are accepted only with a payment in advance equivalent to: Travel Down Payment + Booking Costs + Entry Fee (if required) + Cancellation Insurance Fee (if required). 

4. FULL PAYMENT. 
The payment in full must be made at least 45 days before departure. 

5. VALIDITY OF THE ATTENDANCE FEE. 
Fees, surcharges and terms of the programme are defined according to the exchange rate, the service tariffs, the Italian and foreign taxation in force during the period of the activity. Due to possible fluctuations in any of these elements which would make costs increase, fees could change. If prices increase more than 10%, the Participant has the right to withdraw from the contract without any cost and with a refund of all expenses, on the condition that he send a written statement to BORN2RUN by Melville Travel & Leisure Srl within 72 hours from the receipt of the communication about the increase. 

6. BORN2RUN by Melville Travel & Leisure Srl's WITHDRAWAL. 
The minimum number of participants for all programmes is 20. If such number is not reached, BORN2RUN by Melville Travel & Leisure Srl has the right to withdraw from the contract and cancel the programme. In this case, BORN2RUN by Melville Travel & Leisure Srl must send written communication to the Participant at least one month before, and refund all amounts already paid by the Participant. In case of BORN2RUN by Melville Travel & Leisure Srl 's withdrawal, for any reason except such as acts of God or insufficient number of participants, BORN2RUN by Melville Travel & Leisure Srl will refund the amount paid to the Participant, plus a sum which is equal to the money he would have lost if he had withdrawn on that very day. If the withdrawal is due to acts of God, or reasons not attributable to BORN2RUN by Melville Travel & Leisure Srl, for example: the cancellation or the change of a competition organized by another company, natural calamity, acts of war, epidemics or nuclear transmutation, BORN2RUN by Melville Travel & Leisure Srl has the right to retain the sum corresponding to the costs it has effectively paid to organize the travel. 

7. PARTICIPANT'S WITHDRAWAL. 
The Participant's withdrawal must be reported in writing to BORN2RUN by Melville Travel & Leisure Srl in 42100 Reggio Emilia, Largo Marco Gerra 9, and the communication itself takes effect from the moment in which it is received. If the Participant does not pay punctually the amount indicated in art. 4, BORN2RUN by Melville Travel & Leisure Srl can rescind the contract, according to art. 1456 of the Italian civil code. The annulment of the contract will occur as soon as BORN2RUN by Melville Travel & Leisure Srl Srl informs the Participant about its intention of having recourse to the resolutory clause. In case of the Participant's withdrawal,  BORN2RUN by Melville Travel & Leisure Srl shall retain a sum from the amount paid by the Participant, according to articles 3 and 4.
The following amounts are retained: travel entrance costs + entry fees (when required) + the following percentage according to the attendance fees, for a minimum of € 100,00 per person: 10% if BORN2RUN by Melville Travel & Leisure Srl receives communication 60 or more working days before the scheduled departure (Saturday is considered a non-working day); 25% if BORN2RUN by Melville Travel & Leisure Srl receives communication from 59 to 45 working days before the scheduled departure; 50% if BORN2RUN by Melville Travel & Leisure Srl receives communication from 44 to 30 working days before the scheduled departure; 75% if BORN2RUN by Melville Travel & Leisure Srl receives communication from 29 to 7 working days before the scheduled departure; 100% if BORN2RUN by Melville Travel & Leisure Srl receives communication less than 7 working days before the scheduled departure, or in case of “no-show”, or in case of not regular personal expatriation documents. If the Participant has not paid yet the whole amount defined in this article, he must pay the balance within 10 working days from communication of the annulment.
If the Participant's withdrawal concerns only one or some people but not all the people occupying the room/apartment (for instance, in one room, one person cancels the reservation, the other person(s) keeps the reservation) the person that withdraw from the reservation will pay the penalty as written above, the person that keeps the reservation, will pay the price established for the new arrangement. 

8. CHANGES REQUESTED BY THE PARTICIPANT. 
Any change or integration to the booking have to be requested in writing and entails a charge of € 50,00 per person due to office expenses, in addition to the cost or the difference for any requested service.

9. PERSONAL DOCUMENTS. 
The Participant is liable for his own expatriation documents and for the care and conservation of his travel documents. Should the Participant lose any document, he will have to pay any consequent expense and damage. Any information published by BORN2RUN by Melville Travel & Leisure Srl about this topic concerns Italian citizens who live in Italy. This information is approximate, and BORN2RUN by Melville Travel & Leisure Srl is not therefore liable for it.

10. ANNULMENT PENALTY AND TRAVEL RISK INSURANCES. 
Annulment and travel risks are insurable according to the policy limits of the different Insurance Companies. It is recommended that the Participant takes out a suitable policy with a Insurance Company he can trust.

11. LUGGAGE. 
The luggage travels at the Participant's own risk and peril. BORN2RUN by Melville Travel & Leisure Srl is not liable for any loss or damage.




12. INSURANCE GUARANTEE. 
According to the law, BORN2RUN by Melville Travel & Leisure Srl is insured for the obligations towards the Participant with MONDIAL ASSISTANCE policy n. 51336. 

13. RIGHT OF WITHDRAWAL. 
According to Italian legislative decree 185/1999, anyone who books by mail (that is, not through an intermediary Travel Agency, nor through a Fiduciary, nor through BORN2RUN by Melville Travel & Leisure Srl offices in Reggio Emilia) has the right of withdrawal. It can be asserted within 10 days from the travel booking date, through a registered letter with a form for acknowledgment of receipt to BORN2RUN by Melville Travel & Leisure Srl, Largo Marco Gerra, n°9, Reggio Emilia. It can also be communicated by telegram, telex and facsimile within 10 days, provided that it is confirmed by a registered letter with a form for acknowledgment of receipt within the following 48 hours.

14. ELVIA TRAVEL INSURANCE is a contract between the Participant and Elvia Assicurazioni, regulated by the policy conditions. It is included in the attendance fees.

15. INVOICING. 
BORN2RUN by Melville Travel & Leisure Srl can issue invoices for parties different from the Participant only if payments are made by these parties and if the invoice is required before the departure.

16. ROOM MATE MATCHING 
For selected Events the participant may ask accomodation in room shared with another person, of the same sex. 
In this case the price of the double room will be applied. This accomodation is subject to the fact that another person, of the same sex, requires the same accomodation. 
If that doesn't happen, the participant will pay the price applied for the effective arrangement (the single room).

Born2run is not responsible in case the participant cannot start for the journey due to missing or not regular personal expatriation documents.
